TERMS AND CONDITIONS OF THE ONLINE STORE MATEUSZ SOBIERAJSKI
§. 1. GENERAL PROVISIONS
1. These Regulations have been drawn up on the basis of the provisions of law in force in the territory of the Republic of Poland. The Regulations, together with the provisions of law, exclusively and exhaustively regulate the issues regarding the use and making purchases from the Mateusz Sobierajski store website available at https://mateuszsobierajski.pl
2. The owner and administrator of the Mateusz Sobierajski online store (hereinafter referred to as the Seller or Mateusz Sobierajski) is Mateusz Sobierajski, ul. Lipowa 13b/4, 62-100 Wągrowiec, mobile no. 727925863.
3. The User, the Buyer is any natural person with full legal capacity, a legal person or an organizational unit without legal personality, to which the law grants legal capacity.
4. An entrepreneur is a User conducting business activity within the meaning of the Act of 2 July 2004 on freedom of economic activity (Journal of Laws of 2010, No. 220, item 1447, as amended).
5. A consumer is a User who is a natural person who performs a legal act not directly related to its business or professional activity.
6. A work is a product that can be sold in the Mateusz Sobierajski online store.
7. A purchase is a transaction initiated by the User by placing an order, which leads to the conclusion of a sales contract between the Seller and the Buyer. The purchase is made via the Internet in the form of a distance contract.
8. The user who uses the Mateusz Sobierajski online store is obliged to:
– Not to provide or transmit content prohibited by law;
– using the Mateusz Sobierajski online store in a way that does not interfere with its functioning;
– Not sending and not placing unsolicited commercial information as part of the Mateusz Sobierajski online store;
– using the Mateusz Sobierajski online store in a way that is not inconvenient for other customers and for Mateusz Sobierajski;
– Using the content posted on the Mateusz Sobierajski online store for personal use;
– Use the Mateusz Sobierajski online store in a manner consistent with the provisions in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet. It is forbidden to publish in the Mateusz Sobierajski online store offensive, vulgar, pornographic content and content that is inconsistent with applicable law.
9. Users are forbidden to provide each other with any information that would encourage direct contact, such as e-mail address, telephone number, website address.
10. In order to use the services provided under these Regulations, the Buyer should have:
a. Internet browser: Internet Explorer version not older than 7.0 or Mozilla FireFox version not older than 3.0 or Chrome (all versions) or Opera version not older than 2
b. Java Script enabled
c. An active email address
§. 2. SCOPE AND TYPES OF SERVICES PROVIDED ELECTRONICALLY
1. Mateusz Sobierajski sells Works via an online store and provides the "Newsletter" service.
2. The Mateusz Sobierajski online store accepts orders placed on-line around the clock, on all days of the week. Orders placed on non-working days will be processed on the first working day following the day on which the order was placed.
3. Services provided electronically under these Regulations consist in enabling the use of the Mateusz Sobierajski online store in order to conclude a sales contract and its implementation. The contract for the provision of electronic services is concluded for an indefinite period.
4. The "Newsletter" service consists in sending messages containing information about the current offer, promotions, rebates and discounts. The purpose of the Newsletter service is also to inform customers about events organized by Mateusz Sobierajski and in which Mateusz Sobierajski participates (vernissages, online exhibitions, art fairs). The service is free and requires additional consent to send commercial information.
§. 3. REGISTRATION, CONDITIONS FOR CONCLUSION AND TERMINATION OF AGREEMENTS FOR THE PROVISION OF SERVICES BY ELECTRONIC MEANS
1. The condition for the provision of services specified in the Regulations is to read and accept all provisions of these Regulations.
2. Registration is free and voluntary. After registration, an individual User Account is created for the User.
3. In order to register, the User should complete the registration form. To register, it is necessary to provide: active e-mail address, login and password setting.
4. During registration, it is also possible to provide shipping data. If the form is filled in by the Consumer, these are:
a. Name and surname,
b. Address of residence (street, building number, apartment number, postal code, city, province, country).
5. In addition, in the event of frequent absence of the Consumer from the place of residence, it is optional to provide an additional shipping address (being, for example, a work address with an indication of working hours).
6. If the User is an Entrepreneur, it is necessary to provide the following data to register: active e-mail address, password to the User Account. During registration, it is also possible to provide data for shipping: company name, tax identification number, name and surname and telephone number of the contact person.
7. Conclusion of a contract for the provision of electronic services is tantamount to submitting the following statements:
a. I start using the services voluntarily and meet the conditions for becoming a User provided for in the Regulations
b. the data contained in the registration form are true and do not infringe the rights of third parties c. I consent to the conclusion of the contract electronically
d. I agree to receive system information, messages from the Mateusz Sobierajski online store necessary to complete the order and information about difficulties, changes or technical breaks in the operation of the Mateusz Sobierajski online store, to the correspondence data indicated in the registration form.
8. The User may terminate the contract for the provision of electronic services at any time.
9. Termination of the agreement by either party, as well as its termination by mutual consent, is tantamount to blocking the User's access to the User Account and its removal.
10. The Mateusz Sobierajski online store may terminate the contract for the provision of electronic services if:
a. the purpose of registration or the method of using the services is obviously contrary to the principles and purpose of the Mateusz Sobierajski online store, or the address data provided by the User raise reasonable doubts as to their correctness or truthfulness and these doubts could not be removed by telephone contact or via e-mail
b. the User's activity is contrary to applicable moral norms, calls for violence or committing a crime, and also if it violates the rights of third parties
c. received an official notification of the unlawful nature of the data provided or related activities, or received reliable information about the illegal nature of the data provided or related activities and previously notified the User of the intention to prevent access to the User Account
d. The User sends unsolicited commercial information or grossly or persistently violates the provisions of the Regulations
11. Objectively justified doubts referred to in par. 10 lit. a should be understood in particular as providing a non-existent town, providing the name of a non-existent street in a given town, providing fictitious data as the recipient's name (e.g. fairy-tale characters).
12. A statement of termination of the contract for the provision of electronic services submitted by the Administrator of the online store Mateusz Sobierajski will be sent to the e-mail address provided in the User Account. Termination of the contract for the provision of electronic services results in the permanent deletion of the User Account. A declaration of termination of the contract for the provision of electronic services submitted by the User may be submitted by sending its content to the e-mail address provided for contact in a separate tab of the Mateusz Sobierajski online store website or by deleting the User Account.
13. If the termination was made by the Operator of the Mateusz Sobierajski online store, re-registration is possible after obtaining the Operator's consent.
14. Termination or termination with the consent of the parties to the contract for the provision of electronic services does not affect the performance of already concluded sales contracts, unless the parties agree otherwise. The term of termination of the contract in the cases specified in sec. 10 is 14 days.
§. 4. TERMS OF SALE
1. Mateusz Sobierajski sells the Works presented on the website of the Mateusz Sobierajski online store. The parties to the sales contract concluded through Mateusz Sobierajski are: the Seller and the Buyer.
2. A sales contract may be concluded with a registered User (having a User Account) and a Buyer making a purchase without registration. The buyer who makes purchases without registration, in order to conclude a sales contract, must each time:
a. provide an active e-mail address, data referred to in § 3 sec. 4 or 6 and
b. read and accept the provisions of the Regulations.
3. Information about the Works, together with the price, presented on the Mateusz Sobierajski online store website does not constitute§.7. DISCOUNT SYSTEM
1. The Mateusz Sobierajski online store reserves the right to create a discount system. The principles of the discount system will be the subject of these Regulations.
2. A user using the Mateusz Sobierajski discount system will be able to take advantage of the discount by providing the discount coupon code when placing the order. The method of obtaining a discount code will be described in the regulations of Mateusz Sobierajski.
3. Registered Users of the mateuszsobierajski.pl website will be notified of any changes to these regulations in advance in accordance with Art. 384 k.c. and will be able to terminate the contract for the provision of electronic services.
§. 8. RETURNS - WITHDRAWAL FROM THE SALES AGREEMENT
1. A consumer who has concluded a distance contract with the Seller has the right to withdraw from the contract without giving any reason within 14 days from the date of taking possession of the Work.
2. To withdraw from the contract, the Consumer must inform the Seller about his decision to withdraw from the contract by an unequivocal statement - for example, a letter sent by post, fax or e-mail. The consumer may use the model withdrawal form.
3. In order to meet the deadline for withdrawal from the contract, it is enough for the Consumer to send information regarding the exercise of the Consumer's right to withdraw from the contract before the deadline for withdrawal from the contract.
4. The Consumer is obliged to return the Work to the Seller or hand it over to the person authorized by the Seller to collect it immediately, but not later than 7 days from the date on which he withdrew from the contract, unless the Seller proposed that he would pick up the item himself. To meet the deadline, it is enough to send back the product before its expiry
5. The consumer bears the direct costs of returning the item.
6. In the event of withdrawal from the contract, the Seller returns to the Consumer all payments received from the Consumer, including the cheapest cost of delivery of products available in the Store (if the cost was covered by the Consumer) immediately, and in any case not later than 14 days from the date on which the Seller was informed on the exercise of the right to withdraw from the contract. The refund will be made using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer has expressly agreed to a different solution. In any case, the Consumer will not incur any fees in connection with the form of payment refund.
7. If the Seller has not offered to collect the item from the Consumer himself, he may withhold the reimbursement of payments received from the Consumer until he receives the item back or the Consumer provides proof of its return, depending on which event occurs first.
8. The consumer is liable for the decrease in the value of the product as a result of using the product in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the product.
§.9. COMPLAINTS
1. The Seller is obliged to provide the Buyer with a Work free from defects and is aware of the liability provided for by law for the compliance of the service with the contract.
2. The Seller is liable to the Buyer if the sold Work has a physical or legal defect (warranty for defects).
3. If the sold Work has a defect, the Buyer may:
a. demand replacement of the Work with a defect-free one,
b. demand removal of the defect
c. submit a price reduction statement,
d. submit a declaration of withdrawal from the contract.
4. If the Buyer finds a defect in the Work, he should inform the Seller about it, at the same time specifying his claim related to the defect found or submitting a statement of appropriate content.
5. The Buyer who exercises the warranty rights may, at the Seller's expense, deliver the defective Work to the Seller's address.
6. The Seller will respond to the complaint submitted by the Buyer within 14 days from the date of delivery of the complaint.
7. Details regarding the Seller's warranty for defects are regulated by the provisions of the Civil Code (Articles 556 - 576).
§. 10. RIGHTS, OBLIGATIONS AND LIABILITIES OF THE PARTIES
1. The Seller will make every effort to ensure that the Mateusz Sobierajski online store and all services made available through it operate continuously without any interruptions.
2. The Seller reserves the right to interfere with the technical structure of the User's Account in order to diagnose irregularities in the functioning of the Mateusz Sobierajski online store services.
3. The Seller reserves the right to temporarily disable some functionalities of the Mateusz Sobierajski online store in order to improve it, add services or carry out maintenance with prior notification to registered Users in advance.
4. The User is obliged to immediately update the data provided during registration in the event of a change, and also to keep secret and secure the login and password to access the User Account in such a way that they do not have access to them.1. Mateusz Sobierajski collects only the data that is necessary for the proper provision of the services offered.
2. The User agrees to the transfer of his personal data to third parties for the purpose and scope necessary for the proper implementation of the services provided under the Regulations. This consent includes, in particular, the transfer of data to the intermediary company in ordering courier services and courier companies in order to send the parcel. In the event that the purchased work is sent not directly from Mateusz Sobierajski but from the artist's studio, the gallery reserves the right to provide the artist with a bill of lading attached to the shipment. Users' personal data base is subject to legal protection. These data are particularly protected and secured against access by unauthorized persons.
3. The administrator of personal data is the Mateusz Sobierajski online store, which processes Users' personal data in accordance with the provisions of the Act of August 29, 1997 on the protection of personal data (consolidated text, Journal of Laws of 2002, No. 101, item 926, as amended) and the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended).
4. The operator of the online store Mateusz Sobierajski may process the following data characterizing the way the User uses the service provided electronically (operational data):
a) markings identifying the User,
b) markings identifying the end of the telecommunications network or the ICT system used by the User,
c) information about the start, end and scope of each use of the service provided electronically,
d) information on the use by the service recipient of the services provided electronically.
5. The operator of the Mateusz Sobierajski online store is not responsible for the authenticity of information and data provided by Users or information about Users made available to other Users. The Store Operator points out that it is not possible to verify them as to their compliance with the actual state.
6. The Mateusz Sobierajski online store provides Users with the exercise of rights under the Personal Data Protection Act, in particular, the User has the right to inspect their personal data and the right to change, correct and request their removal by sending an electronic statement to the e-mail address of the store website Mateusz Sobierajski.
7. Exercising the right to delete your own data from the Mateusz Sobierajski online store system is tantamount to deregistration of the User and termination of the contract. With the deletion of the User Account of the online store, Mateusz Sobierajski will delete the User's data permanently and irretrievably, thus ceasing to process the User's personal data. However, the administrator reserves the right to store data such as the time and IP address of the user's login after deleting the account for the needs of the Police and the prosecutor's office and data necessary to settle the services provided until they are settled.
§. 12. FINAL PROVISIONS
1. In matters not covered by these Regulations, the relevant provisions of Polish law shall apply.
2. In the event of a dispute arising in connection with the performance of the contract concluded on the basis of the Regulations, the parties undertake to resolve it in an amicable manner, acting in good faith.
3. If it is impossible to reach an agreement in the manner indicated in par. 2. The court competent for the settlement of the dispute will be the court competent for the registered office of Mateusz Sobierajski. The preceding sentence does not apply to disputes to which the Consumer is a party.
4. The Mateusz Sobierajski online store reserves the right to change the Regulations. Information about the changes will be posted on the Mateusz Sobierajski store's website. Registered Users will also be notified of each change to the Regulations by e-mail with the right to terminate the contract within 14 days. Amendments to the Regulations come into force upon the expiry of the notice period. For orders placed before the entry into force of the amendments to the Regulations, the provisions of the Regulations in the wording applicable at the time of placing the order shall apply.
5. The Regulations are valid from July 8, 2023.

2. The Seller reserves the right to interfere with the technical structure of the User's Account in order to diagnose irregularities in the functioning of the Mateusz Sobierajski online store services.
3. The Seller reserves the right to temporarily disable some functionalities of the Mateusz Sobierajski online store in order to improve it, add services or carry out maintenance with prior notification to registered Users in advance.
4. The User is obliged to immediately update the data provided during registration in the event of a change, and also to keep secret and secure the login and password to access the User Account in such a way that they do not have access to them.1. Mateusz Sobierajski collects only the data that is necessary for the proper provision of the services offered.
2. The User agrees to the transfer of his personal data to third parties for the purpose and scope necessary for the proper implementation of the services provided under the Regulations. This consent includes, in particular, the transfer of data to the intermediary company in ordering courier services and courier companies in order to send the parcel. In the event that the purchased work is sent not directly from Mateusz Sobierajski but from the artist's studio, the gallery reserves the right to provide the artist with a bill of lading attached to the shipment. Users' personal data base is subject to legal protection. These data are particularly protected and secured against access by unauthorized persons.
3. The administrator of personal data is the Mateusz Sobierajski online store, which processes Users' personal data in accordance with the provisions of the Act of August 29, 1997 on the protection of personal data (consolidated text, Journal of Laws of 2002, No. 101, item 926, as amended) and the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended).
4. The operator of the online store Mateusz Sobierajski may process the following data characterizing the way the User uses the service provided electronically (operational data):
a) markings identifying the User,
b) markings identifying the end of the telecommunications network or the ICT system used by the User,
c) information about the start, end and scope of each use of the service provided electronically,
d) information on the use by the service recipient of the services provided electronically.
5. The operator of the Mateusz Sobierajski online store is not responsible for the authenticity of information and data provided by Users or information about Users made available to other Users. The Store Operator points out that it is not possible to verify them as to their compliance with the actual state.
6. The Mateusz Sobierajski online store provides Users with the exercise of rights under the Personal Data Protection Act, in particular, the User has the right to inspect their personal data and the right to change, correct and request their removal by sending an electronic statement to the e-mail address of the store website Mateusz Sobierajski.
7. Exercising the right to delete your own data from the Mateusz Sobierajski online store system is tantamount to deregistration of the User and termination of the contract. With the deletion of the User Account of the online store, Mateusz Sobierajski will delete the User's data permanently and irretrievably, thus ceasing to process the User's personal data. However, the administrator reserves the right to store data such as the time and IP address of the user's login after deleting the account for the needs of the Police and the prosecutor's office and data necessary to settle the services provided until they are settled.
§. 12. FINAL PROVISIONS
1. In matters not covered by these Regulations, the relevant provisions of Polish law shall apply.
2. In the event of a dispute arising in connection with the performance of the contract concluded on the basis of the Regulations, the parties undertake to resolve it in an amicable manner, acting in good faith.
3. If it is impossible to reach an agreement in the manner indicated in par. 2. The court competent for the settlement of the dispute will be the court competent for the registered office of Mateusz Sobierajski. The preceding sentence does not apply to disputes to which the Consumer is a party.
4. The Mateusz Sobierajski online store reserves the right to change the Regulations. Information about the changes will be posted on the Mateusz Sobierajski store's website. Registered Users will also be notified of each change to the Regulations by e-mail with the right to terminate the contract within 14 days. Amendments to the Regulations come into force upon the expiry of the notice period. For orders placed before the entry into force of the amendments to the Regulations, the provisions of the Regulations in the wording applicable at the time of placing the order shall apply.
5. The Regulations are valid from July 8, 2023.
